Pursuant to art. 54 of the Consumer Code, the right of withdrawal may be exercised using by the Consumer using one of the following methods:
• use of the withdrawal form to be completed in full and sent to the Seller by e-mail at the following address: email@example.com
• use of the withdrawal form to be completed in full in all its fields and sent by registered letter with return receipt;
• sending, by registered letter with return receipt and / or certified e-mail to the Seller, an explicit declaration of the Consumer's decision to withdraw from the contract.
The Seller will reply to the Consumer's request for withdrawal within 24 hours by e-mail from firstname.lastname@example.org.
The goods can be returned via a forwarder chosen by the Consumer, at the Consumer's expense and at his/her own risk.
The goods to be returned must be delivered to GaiaInterni within 14 days from the date in which the Consumer has communicated to the Seller the decision to withdraw from the contract.
The right of withdrawal is exercised correctly if the following conditions are fully met:
A. within 14 days of receipt of the goods, the Consumer has followed the above instructions;
B. the goods have not been installed or damaged;
C. the goods are returned in their original packaging and packed with special protection systems and the indication "fragile" or similar clearly visible on the outside of the packaging.
Pursuant to art. 56 of the Consumer Code, if the withdrawal has occurred correctly, the seller refunds the Consumer in full for the price of the goods purchased for which the withdrawal has been exercised, excluding shipping costs relative to the return of the goods.
In the event that the return cannot be accepted because the goods are not intact, incomplete or damaged, the Consumer will be able to choose, where possible, against the retention of the goods by the Seller, to obtain a partial refund, calculated by deducting the cost of the decrease in value of the returned goods according to the margin differential criterion between new and used product; or, alternatively, you can request the return of the goods for which you have requested the return with travel expenses at your expense. If the Consumer refuses the above solutions, the Seller reserves the right to withhold the goods and the amount corresponding to the purchase price of the products until further notice by the Consumer and for a maximum of three (3) months, after which the product is considered definitively abandoned, with the seller's right to permanently withhold the price paid.
Pursuant to art. 52 of Legislative Decree no. 206/2005, the consumer customer can exercise the right of withdrawal, subject to the exceptions referred to in Article 59.
Some products sold by Emmegi are excluded from the right of withdrawal, pursuant to art. 59 lett. c) of the Legislative Decree n. 206/2005 as goods that are ordered from producers and manufactured with the characteristics and customizations requested by the customer (by way of example and not limited to: optional for bathtubs and whirlpools, non-standard taps etc.). In these cases, the exclusion from the right of withdrawal will be appropriately highlighted at the time of the conclusion of the order.
